Terms of use
Short version: use the site, take the check, keep the report. It is guidance rather than advice, the method is mine, your answers are yours, and nothing here forms a contract for work. That is agreed separately and in writing.
Who you are dealing with
This site is operated by Chinmaya Dash, trading as The Modern Analytics, from Bengaluru, India. Contact is chinmaya@themodernanalytics.com and a person answers it.
The check and the baseline are guidance, not advice
The free gate check and the 7D Baseline are self scored. They take your own answers about your own organisation and organise them. They are a structured way to think, and a starting point for a conversation.
They are not an audit, a professional opinion, a legal or regulatory determination, or a substitute for advice that takes your actual circumstances into account. A score is not a verdict, and a low one is not a finding. Please do not present either as an assessment somebody independent performed on you, because nobody did.
Anything on this site about regulation, including the AI Act, data protection law or sector rules, is general and current at the time of writing. It is not legal advice. Take that from your own counsel.
Decisions you make
You are responsible for what you decide. I can give you a better structure for a decision and I cannot make it for you, and neither the check nor the baseline creates any duty of care between us. That begins when we sign a statement of work, and its terms govern, not these.
Who owns what
Yours. Everything you type in. Your answers, your organisation's details, and the report generated from them. The report is yours to keep, print, circulate internally and act on. I claim nothing over it.
Mine. The 7D method, the gate definitions, the scoring model, the wording, the diagrams and the code behind this site. You are welcome to use the method inside your own organisation and to reference it with attribution. You may not repackage it, sell it, or offer assessments based on it as a service without asking me first. Ask, and the answer is often yes.
Accuracy, and when things break
I write this carefully and I keep it current, and it is still a website. If something is wrong or out of date, tell me and I will fix it rather than argue about it.
The site is provided as it is. I do not promise it will always be available, and to the extent the law allows I am not liable for loss arising from using it or being unable to. Nothing here limits liability for death, personal injury, or fraud, because that cannot be limited and should not be.
Links out
Where I link to LinkedIn or anywhere else, that site is theirs and its terms apply, not mine. A link is not an endorsement of everything on the other end of it.
Getting in touch, and being got in touch with
Using the forms means you are happy for me to reply to you about what you asked. It does not sign you up to anything else. There is no newsletter, and there is no list you have been added to. The privacy notice sets out exactly what is held and for how long.
Governing law
These terms are governed by the laws of India and the courts of Bengaluru have jurisdiction. If you are a consumer somewhere with stronger protections, you keep those. Engagement contracts may specify a different governing law, and where they do, they win.
Changes
If these change materially I will date the change here. Last updated August 2026.
These are plain English terms written by the person who runs the site, not by a solicitor. They are honest and they are readable. If you are about to do something significant on the strength of them, have your own lawyer read them, which is exactly the advice I would give about anything else on this site.
